Welcome to Timber & Tide! We’re so glad you’re here. Timber & Tide is a small, family-run workshop in the coastal foothills of Oregon (Monroe area) where we handcraft cozy, useful, and beautiful items inspired by the Pacific Northwest, books, home, and simple joys. These Terms of Service (“Terms”) govern your use of our website (timberandtide.studio) and your purchases from us. By accessing our site, creating an account, or placing an order, you agree to these Terms. Please read them carefully.

If you do not agree, please do not use our site or make a purchase.

1. Our Products and Handmade Nature

Timber & Tide offers handmade and custom products including (but not limited to) laser-engraved wooden and acrylic items (bookmarks, keychains, signs, jumbo clips, herb strippers, etc.), 3D-printed items (fishing lures, thumb page holders, book weights), curated book bundles, Date Night with a Book sets, and personalized keepsakes.

Important – Handmade Items: Because our products are handcrafted in small batches in our Oregon workshop, minor variations in wood grain, color, engraving depth, size, finish, or appearance are normal and add to the unique character of each piece. These natural variations do not constitute defects or grounds for return under our standard policy. We strive for consistency while celebrating the one-of-a-kind nature of handmade goods.

Product descriptions, photos, and specifications are as accurate as possible. Slight differences between the website image and the physical item may occur due to lighting, screen settings, or the handmade process.

2. Custom and Personalized Orders

Many of our items can be personalized or made to order (e.g., custom signs, engraved names/words/phrases on clips or bookmarks, specific book bundle curation, or made-to-order fishing lures).

  • Custom orders are subject to the production timelines listed on the product page or stated in your order confirmation.
  • Cancellations for custom orders are accepted within 48 hours of placement, provided production has not begun. After production starts, custom orders are generally non-cancellable and non-refundable (see our Return & Refund Policy for details and defect exceptions).
  • We will communicate via email if production has started on your custom order.

By placing a custom order, you acknowledge and accept these terms specific to personalized/made-to-order items.

3. Account Registration and Security

You may create an account to track orders, save favorites, or manage returns more easily. You are responsible for:

  • Providing accurate information.
  • Maintaining the confidentiality of your account and password.
  • All activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

4. Orders, Pricing, and Payment

  • All prices are listed in USD and are subject to change without notice (changes do not affect orders already placed).
  • We accept payment through secure processors available at checkout (e.g., Shopify Payments, credit/debit cards, etc.). You authorize us to charge the full amount at the time of order.
  • Orders are subject to acceptance and availability. We may refuse or cancel any order for reasons including pricing errors, suspected fraud, or stock issues. If we cancel, we will notify you and issue a full refund.
  • Taxes and shipping are calculated at checkout and are your responsibility (unless we offer free shipping promotions).

5. Shipping and Delivery

Shipping details, timelines, costs, and our free shipping threshold (currently $100 within the US) are outlined in our separate Shipping Policy. Please review it before ordering. International shipping is available to select countries with additional costs and longer delivery times.

Risk of loss and title pass to you upon delivery to the carrier (or upon pickup if local).

6. Returns, Refunds, and Exchanges

Our full Return and Refund Policy (including eligibility, 30-day window for most items, custom order rules, damaged/defective processes, and who pays return shipping) is incorporated into these Terms by reference and available at [link to your Return Policy page or /policies/refund-policy].

7. Intellectual Property

All content on this site—including product designs, engravings, photos, descriptions, graphics, logos, text, and the “Timber & Tide” name and branding—is owned by or licensed to Timber & Tide (Celena & Rodney) and is protected by copyright, trademark, and other laws.

You may not copy, reproduce, distribute, modify, or create derivative works from our content or products for commercial purposes without our prior written permission. Personal, non-commercial use (such as sharing photos of items you purchased) is generally fine with attribution.

8. User Content and Reviews

If you submit reviews, photos, comments, or other content (“User Content”):

  • You grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with our business (website, social media, marketing, etc.).
  • You represent that you own or have rights to the content and that it does not violate anyone else’s rights or these Terms.
  • We may remove or moderate User Content at our discretion (e.g., false, offensive, or spam reviews).

We appreciate honest feedback and photos of our items in your homes!

9. Prohibited Uses

You agree not to:

  • Use the site for any illegal purpose or in violation of any laws.
  • Attempt to gain unauthorized access, scrape data, or interfere with the site’s operation.
  • Post false, misleading, or defamatory content.
  • Use our products in any unsafe or illegal manner.
  • Resell our products without authorization or misrepresent them as your own handmade work.

We reserve the right to refuse service or terminate access for violations.

10. Disclaimers and Limitation of Liability

To the fullest extent permitted by law:

  • Our site and products are provided “as is” without warranties of any kind (express or implied), including merchantability or fitness for a particular purpose, except as expressly stated in our Return Policy or product descriptions.
  • We are not responsible for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the site or products.
  • Our total liability for any claim related to a product shall not exceed the amount you paid for that product.
  • Handmade variations, production delays on custom orders, or third-party content (e.g., books in bundles) do not create liability beyond what is stated in these Terms and our Return Policy.

Some jurisdictions do not allow certain limitations, so they may not apply to you. This does not affect your legal rights for defective goods.

11. Indemnification

You agree to indemnify and hold harmless Timber & Tide, its owners, and team from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the site, your orders, your User Content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles.
